EEOC Announces Collection of EEO-1 Data in 2021

On January 12, 2021, the U.S. Equal Employment Opportunity Commission (EEOC) announced it will begin collecting Form EEO-1 workplace demographic data for calendar years 2019 and 2020. The EEOC delayed collection of 2019 data due to the COVID-19 pandemic.
The EEOC will open four data collections this year. The collections are scheduled to open in the following months:

- April 2021: 2019 and 2020 EEO-1 Component 1 Data Collection (Private Sector Employers)
- July 2021: 2020 EEO-5 Data Collection (Public Elementary/Secondary School Districts)
- August 2021: 2020 EEO-3 Data Collection (Local Referral Unions)
- October 2021: 2021 EEO-4 Data Collection (State/Local Governments)
In general, all private-sector employers with 100 or more employees are required to file an annual EEO-1. Federal contractors with 50 or more employees and contracts with the federal government in excess of $50,000 are also required to file an EEO-1. Employers meeting this criteria should begin gathering data to prepare to submit data in anticipation of these openings.
The precise opening dates of the collections, as well as the new submission deadline dates, have not yet been announced by the EEOC. But as in previous years, the EEOC will send eligible filers a notification letter.
